In March, the Chicago regional director of the National Labor Relations Board (NLRB) ruled that Northwestern scholarship football players are employees of the university and therefore have the right to form a union.In April, Northwestern University appealed the decision to the full NLRB in Washington, D.C.This weekend, the Northwestern football team, still awaiting a final decision from the NLRB, comes to Notre Dame with its unionization future unclear. Ed Edmonds, associate dean of the Notre Dame Law School, said either way the Board rules, the Northwestern case could be pivotal for the future of collegiate athletics.Susan Zhu | The Observer “I would like to think that this [case] would begin to change the conversation at the NCAA away from the idea that [athletics] should be equated to a hobby or a very modest expenditure of time,” Edmonds, who specializes in sports labor law, said. “I think we need to have a much more realistic conversation about how you try to balance intercollegiate athletics and its demands with the educational process.“I mean, we’re basically the only country in the world that has sports so intertwined with the educational process at the highest levels. And I think what the case has helped advance is a conversation that is badly needed.”Following the Chicago Regional Board’s decision in March, members of Northwestern’s football team voted on whether or not they wanted the College Athletes Players Association (CAPA) to represent them. Edmonds said the results of the vote will remain embargoed until the full NLRB’s ruling and will only be counted if the Board rules in CAPA’s favor.Edmonds said the Board’s review period for the Northwestern case is typical, and he expects a decision by the end of the year. In the meantime, he said the case is an opportunity to consider how universities and the NCAA treat athletics and student athletes.“The most significant thing about the case, to me, was the fact that the regional board ruled in favor of the players,” Edmonds said. “It actually causes everybody to look very carefully at the definition of a student athlete.”In its list of core values, the NCAA prioritizes “the collegiate model of athletics in which students participate as an avocation, balancing their academic, social and athletics experiences.” Edmonds said this definition is problematic when student-athletes are pushed for significantly more time and effort than non-athletes.“In the brief that Northwestern filed, [they] said, ‘Well, participating in college football is no different than 400 and some-odd other student activities that we have at the university,’” Edmonds said.“They’re trying to say if you participate in the chess club or something along those lines that that’s the same as participation in intercollegiate football. I think those kinds of assertions, that seem laughable to me, make the arguments in this case sometimes really problematic.“The incredible amount of money that conferences get, the incredible amount of money the NCAA basketball tournament generates — that places it in a far different category than anything else that Northwestern students participate in.”The Northwestern NLRB case itself revolves around the definition of employment and whether or not scholarship athletes fit that definition. Notre Dame associate professor of law Barbra Fick, who specializes in labor law, said the definition of employee typically depends on pay and control.In the Northwestern case, Edmonds said NLRB Chicago regional director Peter Sung Ohr ruled the football scholarships were economic benefits and coaches exercised some control over the players, thus making them employees. The University, though, objected to Ohr’s interpretation of scholarships as income.“What Northwestern tried to present in this case … is [scholarship athletes] don’t pay any income tax on their scholarship benefits so that should be an indication that they’re not employees,” Edmonds said. “Ohr discounted that.”In recent years, Edmonds said the idea of scholarships as income has grown more viable due to increasing tuition costs. According to the Northwestern University Office of Undergraduate Admission, the annual cost of attendance is $65,554, which totals to roughly $262,216 over four years.“One of the things that has changed a lot over the years is as tuition has risen, the value of [athletic] scholarships becomes, to a lot of people, fairly important,” he said. “So even tough [student athletes] aren’t given a paycheck, they are given a pretty significant economic benefit. And I think in this day and age when a lot of people take on a lot of debt to go to elite private universities, that’s begun to change the way some people look at the issue of whether or not college athletes are exploited.”The Chicago Regional Board did distinguish between scholarship and walk-on athletes, determining walk-ons are not employees. On its website, CAPA said it could possibly represent walk-on and “nonrevenue” athletes in the future, but “it would depend on the applicable labor laws and details surrounding their athletic arrangement.”Former Northwestern quarterback Kain Colter, who graduated in 2014 and led the unionization effort last year, leads CAPA, along with former UCLA linebacker Ramogi Huma and former University of Massachusetts Amherst basketball player Luke Bonner.On its website, CAPA lists its goals, which include “guaranteed coverage for sports-related medical expenses for current and former players, minimizing the risk of sports-related traumatic brain injury [and] improving graduation rates.”Edmonds said if the full NLRB rules in favor of the players, CAPA could bargain over these issues on behalf of scholarship football players at Northwestern and 16 other private universities with Division-I football, including Notre Dame, if they voted for representation. The union could not represent athletes at public universities because the National Labor Relations Act does not grant public employees collective bargaining rights, Edmonds said.“If the full board rules in favor of the players, it raises the question of whether any of the other private universities that play Division-I football would be approached by CAPA,” Edmonds said. “And I think CAPA would try to approach all of the schools.”He said athletes would react differently from campus to campus to the prospect of unionization, but if the NLRB rules in favor of CAPA and the Northwestern players voted to unionize, Notre Dame scholarship athletes could consider joining CAPA, too.Edmonds said the full NLRB’s decision is “a real toss-up” at the moment, but the Northwestern case is part of a larger conversation about the role of athletics at major universities.“The big thing about this … is that maybe we can now begin to talk about student athletes — if you want to call them that — in a different way because they generate such an incredible amount of revenue for their university,” Edmonds said. “If you want to maintain this idea of a student athlete, then you really ought to switch it and say it’s an athlete student, because they’re a full-time athlete and a part-time student.”Regardless of the outcome of the NLRB’s decision, Edmonds said the Northwestern case, along with several lawsuits that “strike even more directly at the core of the way the NCAA conducts business” will shape the future of college sports.“I’m hard-pressed to imagine that the situation is going to be exactly the same in a decade than it is now,” Edmonds said. “To me, it’s part of a broader discussion about the role of intercollegiate athletics in the university that’s being pushed by a host of things, and this is just one aspect of a lot of things that are aimed at whether the NCAA’s model is really a workable one anymore.”Tags: CAPA, college football, Ed Edmonds, NCAA, NLRB, Northwestern University, Peter Sung Ohr, Unionization

TORONTO – With a sigh and hesitant pause, Jason Paris confides that in retrospect he wishes he’d done more research before putting down a deposit on the now defunct Museum FLTS condominium project in Toronto’s trendy Lower Junction area.The 43-year-old television production manager is one of hundreds of would-be homeowners who recently had their money returned and dreams dashed when the building’s developer, Castlepoint Numa, cited lengthy delays obtaining the necessary approvals, building permits and financing, as reasons for the halt.“If I had the knowledge I have now, then, I definitely would have researched Castlepoint further,” said Paris, who subsequently found out that the developer did the same thing to other hopeful Toronto condo buyers a few years ago when another one its projects fell through.While Castlepoint Numa said it’s giving original Museum FLTS buyers the first opportunity and a discount on the next residential phase of its greater Lower Junction neighbourhood project, Paris points out that some buyers have been burned twice in a row by the same developer.The best line of defence for prospective presale condo buyers seeking to mitigate any potential fallout is to do the appropriate due diligence on the developer before signing any contracts, experts say.Unfortunately, there’s not much that can be done to protect Paris and others like him who become the victims of a cancelled condo complex, said Vancouver real estate lawyer Richard Bell.“It does happen in various scenarios, particularly if there’s a significant downturn in a market over a short period of time. So really, people are at risk,” said Bell, who works for law firm Bell Alliance.The bottom line? Do your homework, Bell said.“Who is the developer? What have they built previously? A new developer entering the market place is going to greater risk in a situation for a buyer than having a very experience developer in the market place.”The key advantage of using seasoned developers is that they have a name and brand to protect, notes Toronto real estate lawyer Mark Weisleder.“I have heard of situations where the builders have cancelled the deal and then turned around and then resold units at a $100,000 more each, and there’s virtually nothing that the original owners could do because there were lots of clauses in the contracts that allowed builders to cancel,” said Weisleder.“But you will find that reputable people, people who have been around a long time, they don’t do that. When they plan a development and plan units, they’re expected to complete. They price accordingly and they complete.”Keep in mind, Weisleder added, that even in Toronto’s increasingly competitive condo market — where the average selling price for a unit is about $523,000 — approximately 95 to 97 per cent of developments will see completion. According to real estate consultancy Urbanation, 23 condo projects have been cancelled in the city since 2012 — five of them in the last year.Bell said that the last time he’d heard of a cancelled condo development in Vancouver was in 2008, during the financial crisis.Jason Paris believes he is luckier than some because he only got involved with the cancelled condo project in February, when he signed a contract and handed over his deposit.“Some people had their investment off the market for a year and a half. TORONTO – Protests, labour unrest and a public feud between Tim Hortons and the premier of Ontario have erupted in the wake of the province’s recent minimum wage hike, raising questions about the wisdom of raising the standard by 30 per cent in just two years.The experiences of Alberta and Seattle, two jurisdictions that share Ontario’s $15 an hour goal, offer some lessons on how to adjust to a higher minimum wage: that is, if Ontario businesses can weather the short-term storm.Ontario’s rate increased to $14 per hour from $11.60 — a 21-per-cent jump— on Jan. 1. The province aims to get to $15 by Jan. 1, 2019.Measures taken to offset Ontario’s changes have landed several businesses, including the country’s iconic Tim Hortons, in hot water after it was revealed that some franchisees cut employee benefits, breaks or tipping to offset the impact of minimum wage hikes.A similar scene unfolded three years ago in Seattle when that city’s minimum wage legislation went into effect.The city committed to phasing in a $15 minimum wage increase, using a tiered system that gives small businesses several more years to adjust than large corporations.Still, reports suggest some businesses levied surcharges to cover higher wages, while others discouraged customers from tipping.The backlash has mostly subsided, but economists are divided on what the early findings suggest about the economic fallout from the substantially higher standard.A University of Washington study published last year revealed Seattle’s wage hike triggered higher salaries but a reduction of hours for lower earners, with a net effect of reducing low-wage workers earnings by $125 per month.However, the research methods of the study have been called into question by some economists who argue that it failed to account for a booming economy that pushes more workers into higher paid jobs, resulting in a decrease of hours for minimum wage workers.The University of California, Berkeley, published a conflicting report around the same time finding the predicted doomsday scenarios had not materialized.“So far there is nothing alarming happening in Seattle due to minimum wage,” said Sylvia Allegretto, one of the authors of the report.“Certainly we don’t see any effects to be concerned or worried about.”The June 2017 study by Allegretto and two colleagues on Seattle’s restaurant industry found that for every 10 per cent that the minimum wage rose, pay in the overall industry rose by about one per cent, with no impact on employment.Allegretto said she’s working on updating the study, which will contain observations from five other cities rolling out minimum wage increases — including San Francisco, Los Angeles and Chicago.A broader U.S. study published in May 2016 from the National Employment Law Project looking at 22 federal minimum wage hikes over seven decades found no connection between wage increases and dips in employment rates. It further revealed that in 68 per cent of the cases examined between 1938 and 2009, employment jumped after a hike.Elsewhere in Canada, companies in Alberta appear to be adjusting to the hike from $12.20 to $13.60 last October and are getting ready for plans to further increase it to $15 this year.James Boettcher, the CEO of Calgary ice cream purveyor Fiasco Gelato, said Ontario businesses will see challenges with the hike, but “good companies will find a way to make it work.”Still, he said he’s frustrated that governments haven’t taken tipping into account or considered a lower wage for teenagers still attending school or living at home when it comes to setting new standards for minimum wage.Carolina Lopez, owner of Calgary’s Minas Brazilian Steakhouse, initially tacked on a four per cent “small business support fee” to bills after the province’s minimum wage hike but instead decided to raise menu prices after receiving some backlash. At her own favourite restaurants, she said she’s seen “a decrease in the quality of the product and the amount.”To Ontario business owners she said to remember: “There is always a way, but there is also a limit and it won’t be easy.”

Eyewitnesses say a small explosion was heard after the fire started. The fire quickly spread to a nearby parked car.At almost the same time, the Fort St. John Fire Department was also called to a vehicle fire at an apartment building on 86 street near the Best Western Hotel. New Delhi: Congress leader Hardik Patel Monday moved the Supreme Court challenging the Gujarat High Court order rejecting his plea to stay his conviction in the 2015 Vispur rioting case. His petition is likely to be mentioned Tuesday for urgent hearing and his lawyers would seek stay of the March 29 order of the High Court which is coming in the way of his contesting the Lok Sabha election. Patel, 25, had started preparations to contest from Jamnagar on a Congress ticket after joining the party on March 12 and the last date for filing of nominations is April 4. Polling for 26 Lok Sabha seats in Gujarat will be held on April 23. The Sessions Court at Visnagar in Mehsana district sentenced Patel to two years’ imprisonment last July for rioting and arson in Visnagar town in 2015 during the Patidar quota stir which he led. The high court in August 2018 suspended the sentence but not the conviction. Under the Election Law — Representation of the People Act and a related Supreme Court ruling — a convict facing a jail term of two years or more cannot stand for election unless the conviction is stayed. In the high court, the state government had submitted that there were 17 FIRs including two sedition complaints against Patel who is known for making inflammatory speeches. Washington DC: After a deadly crash in Indonesia, American Airlines pilots called a meeting to press Boeing executives for safety changes to the 737 MAX aircraft, US media reported Tuesday. The call for changes, which could have required the best-selling aircraft model to be temporarily grounded, were reported by The New York Times and CBS News after they obtained an audio recording of the November 27 meeting between the American Airlines pilots union and officials from the aircraft manufacturer. But the meeting shows that pilots were already worried about the safety of the model following the October 2018 crash in Indonesia of a Lion Air 737 MAX 8 that left no survivors of the 189 people onboard. Meanwhile, the pilots in the meeting said they felt they weren’t told enough about the MCAS system, which was new to the 737 MAX 8. “These guys didn’t even know the damn system was on the airplane, nor did anybody else,” said Mike Michaelis, head of safety for the pilot’s union. Following the Lion Air crash, Boeing had issued additional instructions to pilots in case they faced a malfunction of the MCAS. But in a letter obtained by AFP, Michaelis said the instructions weren’t sufficient for pilots to know how to handle malfunctions with the anti-stall system.
